Increased Prosecutions Lead to Increase in Wrongful Convictions
The DA’s office has ramped up its prosecution of sex offenses, especially those involving children. The Grimes County district court has responded to this strict prosecution policy in child sex abuse cases with harsh prison sentences and hefty fines. A Navasota man was given three life sentences in a child sexual assault case in 2015 and the sentences were upheld by an appeals court in 2016.
“These are gut wrenching cases to try,” District Attorney Tuck McLain said after the jury verdict. “They are hardest on the child, but they take their on all involved. I am grateful to the jury for their attention and hard work. It is not easy to take the better part of a week and listen to this kind of testimony. Sometimes, I think they may need counseling after the cases end. They endured it and stood up for this young victim.”
With increased emphasis on child sex abuse prosecutions by the DA’s office, there will be false allegations, especially in divorce proceedings and other disputes involving child custody and blended families. Reputable studies reveal that false child sex abuse allegations are made in anywhere from 6 to 35 percent of these cases. Some of these will occur in Grimes County.
The Texas Department of Public Safety’s Uniform Crime Report for 2016 found that the number of sex offenses in the state increased by 7.7 percent last year.
The Department of Family and Protective Services reported that of the 66,075 confirmed cases of child abuse in the state in 2016, nearly 6,000 of them involved sexual offenses. Many of these will ultimately prove to be false.
