In 2015, the Hidalgo County District Attorney’s Office, located in Edinburg, created a new Sex Crimes Unit, staffed by its best and most experienced prosecutors, to handle the prosecution of child sex abuse cases.

The DA’s office handled more than 179 sex-related cases involving children between October 2015 and September 2016. The Department of Family and Protective Services reports that for every 10,000 children living in Edinburg, approximately 11 of them are victims of sexual abuse.

The Texas Department of Public Safety’s Uniform Crime Report for 2016 found that the number of sex offenses in the state increased by 7.7 percent last year. That is reflected in the number of sexual assaults in Edinburg increasing from 49 in 2015 to 61 in 2016.  The same report shows sexual assaults increasing from 16 in 2015 in McAllen to 40 in 2016.

Increased Prosecutions Lead to Increase in False Allegations

The DA’s office has ramped up its prosecution of sex offenses, especially those involving children. This is evidenced by the fact that as of September 2017, there were 1271 registered sex offenders in Hidalgo County, 234 of who are registered in Edinburg.

The Hidalgo County district courts have responded to the crime increase. In June 2016, an Edinburg man was sentenced to 30 years for sexually abusing two girls under the age of 10. Another defendant from McAllen received a life sentence for sexually assaulting a teenager.

With increased emphasis on child sex abuse crime prosecutions by the DA’s office, there will be false allegations, especially in divorce proceedings involving contentious child custody disputes. Reputable studies reveal that false child sex abuse allegations are made in anywhere from 6 to 35 percent of these cases.

Registration in Texas

Conviction of any sex offense requires that the offender register with local law enforcement under both federal and state law thereby placing his name/address in a public registry. This can dramatically alter a person’s life, forever. Securing employment and safe housing become exceedingly difficult. Friends, and even family, tend to drift away. Depression becomes a fixture in a registered sex offender’s life.

The John T. Floyd Law Firm is committed to not letting a child sex abuse allegation lead to a conviction and ultimately to sex offender registration.

If you, or a loved one, is under investigation, or has been charged with a child sex abuse offense, it is imperative that you seek legal representation as soon as possible.
