The U.S. Department of the Treasury’s Office of Foreign Assets Control (OFAC) administers and enforces economic and trade sanctions based on U.S. foreign policy and national security goals. Foreign Terrorist Organizations and OFAC Designations
The U.S. Department of State designates Foreign Terrorist Organizations (FTOs) under Section 219 of the Immigration and Nationality Act (INA).
These designations carry legal consequences, including immigration restrictions and criminal penalties for providing material support.
While the State Department maintains the official FTO list, many FTOs also appear on OFAC’s Specially Designated Nationals (SDN) List under Executive Order 13224 and related authorities. When this occurs, all assets of the designated group or individual under U.S. jurisdiction are frozen, and U.S. persons are generally prohibited from engaging in transactions with them.
This dual designation structure allows for both immigration and financial restrictions to be imposed against foreign terrorist groups and their supporters, reinforcing U.S. counterterrorism objectives.

In a memorandum dated May 12, 2025, titled “Criminal Division White‑Collar Enforcement Plan: Focus, Fairness, and Efficiency in the Fight Against White‑Collar Crime,” the Department of Justice highlighted sanctions evasion as a top-tier enforcement priority. The memo places it alongside other critical areas, such as procurement fraud, trade and customs fraud, and healthcare fraud. This prioritization highlights the increasing importance of utilizing criminal enforcement to combat sanctions violations and preserve the integrity of U.S. national security interests.
Additionally, a May 2025 presentation by the law firm Gibson Dunn emphasized the Department of Justice’s heightened focus on sanctions enforcement. The presentation noted a clear policy shift toward a more aggressive pursuit of sanctions-busting arrangements, signaling the DOJ’s intent to expand prosecutions in this area and enhance interagency coordination with OFAC and the Department of Commerce.
According to the Gibson Dunn analysis, this elevated enforcement posture reflects a broader strategic realignment at the DOJ. U.S. Export Controls and Restricted Countries
In parallel with OFAC sanctions, the U.S. enforces a range of export controls that restrict the transfer of sensitive goods, technology, and services to foreign persons or destinations. These controls are primarily managed by the Department of Commerce and the Department of State, serving to advance U.S. national security and foreign policy objectives.
Export Administration Regulations (EAR) — Administered by the Bureau of Industry and Security (BIS) under the Department of Commerce, the EAR governs “dual-use” items—goods and technologies with both civilian and military applications. Controls vary by item, end-user, and destination.
International Traffic in Arms Regulations (ITAR) — Administered by the Department of State’s Directorate of Defense Trade Controls (DDTC), ITAR regulates defense articles, technical data, and defense services under the U.S. Munitions List (USML).
Nuclear Export Controls — Overseen by the Department of Energy (DOE) and Nuclear Regulatory Commission (NRC), these cover nuclear materials and technologies, including those governed by the Atomic Energy Act.
Anti-Boycott Regulations — Enforced by the BIS and the IRS, these laws prohibit U.S. persons from cooperating with unsanctioned foreign boycotts (e.g., the Arab League boycott of Israel). (“Not sanctioned” means the U.S. government does not endorse or authorize the boycott as part of its official foreign policy.) A “foreign boycott” under these rules must be organized, supported, or imposed by a foreign government, not private actors or companies.
These rules were enacted following the Ribicoff Amendment to the Tax Reform Act of 1976 and the Export Administration Act of 1979. They are designed to prevent U.S. businesses from participating in discriminatory trade practices and to reinforce U.S. foreign policy objectives.
- Prohibited conduct includes agreeing to refuse business with boycotted countries (e.g., Israel), furnishing information about business relationships with boycotted nations, or implementing discriminatory letters of credit.
- Violations may result in civil penalties of up to $300,000 per occurrence and criminal penalties of up to $1 million, as well as imprisonment for up to 20 years.
The laws have been challenged on First Amendment grounds, but courts have upheld them as constitutional, arguing that they are economic regulations targeting commercial conduct, not political speech. In Truitt v. Department of Commerce (D.C. Cir. 1984), the court affirmed the government’s authority to restrict compliance with foreign boycotts not sanctioned by U.S. policy.
Deemed Exports — A “deemed export” occurs when controlled technology is released to a foreign national within the United States. Such transfers may require a license just as if the item were exported abroad.
Countries Subject to U.S. Export Controls
Certain countries are subject to comprehensive or targeted export controls due to their involvement in terrorism, human rights abuses, weapons proliferation, or hostile geopolitical behavior. Countries facing the most restrictive U.S. export controls include:

Let me tell you, I never had more confidence then, knowing that the judge held him in such high regard.This is not to mention how personable John is. I'll be honest that during the stress of court, sharing a laugh with your lawyer helps a lot. This may sound a lot, but I really appreciated the relationship we had then.
