In my opinion the statute will withstand any constitional challenge. The Texas scheme requries that the communication be "knowingly." In addition, the communication includes an intent requirment. The statute reads ..."with the intent that the minor engage in sexual contact...." At the moment, I am undertaking a first amendment challenge to an Arkansas statute that requires no scienter or criminal intent to be found guilty. The Texas statute is very well written.
